Terms of Service
These Terms govern your use of Clinic by Kahloon (the “Service”), a clinic management platform operated by Kahloon, LLC (“Kahloon”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. Who we are
The Service is provided by Kahloon, LLC, a company registered in Dover, Delaware, United States. You can reach us at info@kahloon.com.
2. The Service
Clinic by Kahloon helps health centres, clinics, and similar organisations manage their day-to-day operations — patient records, visits, prescriptions, pharmacy, billing, and inventory. It is software for organising clinic workflows. It is not a medical device and does not provide medical advice (see Section 9).
3. Accounts and eligibility
- Clinics are set up as organisations. The clinic is responsible for its staff accounts and for the patient data it enters.
- Patients may create their own accounts to manage their information and appointments.
- You must provide accurate information and keep your account secure. You are responsible for activity under your account.
- You must be old enough to enter a binding agreement in your country, or have authorisation to act on behalf of an organisation.
4. Acceptable use
You agree not to misuse the Service — including attempting to access data you are not authorised to see, disrupting the Service, uploading unlawful content, or using it to violate anyone’s privacy or legal rights.
5. Customer data and responsibilities
Clinics and their users remain responsible for the data they enter, including ensuring they have a lawful basis and any necessary patient consents to collect and process it. We process this data on your behalf as described in our Privacy Policy and Data Processing Addendum.
6. Fees and payment
Paid plans are billed through our payment processor, Stripe. Fees, billing cycles, and any trial terms will be shown before you subscribe. [Pricing and plan details to be finalised.] Except where required by law, fees are non-refundable.
7. Availability and support
We work to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may update, maintain, or change features over time. Support is available at info@kahloon.com.
8. Intellectual property
The Service, including its software, design, and brand, belongs to Kahloon. These Terms do not transfer any ownership to you. Data you enter remains yours.
9. Medical disclaimer
Clinic by Kahloon is a tool to help organise clinical operations. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for professional clinical judgement. Clinicians and clinics remain solely responsible for all clinical decisions and patient care.
10. Limitation of liability
To the maximum extent permitted by law, the Service is provided “as is.” Kahloon is not liable for indirect or consequential losses, and our total liability is limited to [the amount you paid for the Service in the preceding 12 months]. Nothing in these Terms limits liability that cannot be limited by law.
11. Termination
You may stop using the Service at any time. We may suspend or close accounts that breach these Terms. On termination, data is handled as described in the Data Processing Addendum.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will give reasonable notice. Continued use after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Local laws in your country may also give you rights that these Terms do not override.
